Launch Section 337 Investigation! The US Takes a Hard Line on LED Landscape Lighting Equipment This Time
On April 10, 2023, the U.S. International Trade Commission (ITC) voted to initiate a Section 337 investigation into certain LED landscape lighting devices, components thereof, and products containing same (Investigation No. 337-TA-1358).

On March 10, 2023, Wangs Alliance Corporation d/b/a WAC Lighting of Port Washington, New York filed a Section 337 investigation application with the U.S. International Trade Commission (ITC), alleging that the importation, sale for importation, and sale within the United States of this product infringe its intellectual property rights (U.S. Registered Patent Nos. 10,920,971; 10,969,088; 11,274,816), and requesting the U.S. ITC to issue a limited exclusion order and a cease-and-desist order.
Hinkley Lighting, Inc., of Avon Lake, OH, USA is listed as a defendant.
The U.S. International Trade Commission shall determine the end date of the investigation within 45 days after the filing of the complaint. Except in cases where the U.S. Trade Representative disapproves for policy reasons, relief orders issued by the U.S. International Trade Commission in Section 337 cases shall take effect upon issuance and become final on the 60th day following issuance.
