Fine of 160,000! A company was penalized for selling substandard children's desk lamps.

日前,宜家电子商务(中国)有限公司因销售不合格儿童台灯产品被上海市徐汇区市场监督管理局罚款逾16万元没收违法所得逾4万元,处罚日期为2023年2月9日。

据信用中国网站处罚信息显示,具体违法事实为,当事人宜家电子商务(中国)有限公司销售的规格型号为B1701 Krux Max3.4W的儿童读写台灯产品经上海市质量监督检验技术研究院检测,被判定为不合格。经查证,当事人自2022年3月1日起在其运营的线上店铺共销售该款不合格台灯产品共计314台,库存13台。该产品销售标价为249元/台(含税),总计货值金额为80271.84元,利润总计为40729.38元(不含税)。徐汇区市场监督管理局依法对该公司处以罚款16.054360万元、没收违法所得4.072930万元的处罚。


In accordance with Article 50 and Article 55 of the "Product Quality Law of the People's Republic of China", the Xuhui District Market Supervision Administration confiscated illegal gains of 40,729.30 CNY from IKEA E-Commerce (China) Co., Ltd., imposed a fine of 160,543.60 CNY, and ordered the cessation of illegal activities.


It is reported that the official platform can no longer search for the product in question, and customer service responded that there are no related products currently available for sale.


According to Tianyancha App, IKEA E-Commerce (China) Co., Ltd. is a wholly-owned subsidiary of IKEA (China) Investment Co., Ltd.; while IKEA (China) Investment Co., Ltd. is a wholly-owned subsidiary of INGKA PRO HOLDING B.V.


Article 50 of the "Product Quality Law of the People's Republic of China": Where impurities or adulterants are mixed into products, fake products are passed off as genuine, inferior products are passed off as superior, or unqualified products are passed off as qualified, production and sales shall be ordered to cease, illegal products produced or sold shall be confiscated, and a fine of not less than 50% but not more than three times the value of the illegally produced or sold products shall be imposed; if there is illegal income, it shall also be confiscated; in serious cases, the business license shall be revoked; if a crime is constituted, criminal responsibility shall be investigated according to law.


Article 55 of the "Product Quality Law of the People's Republic of China": If a seller sells products prohibited from sale under Articles 49 to 53 of this Law, and there is sufficient evidence proving that they were unaware that the product was prohibited for sale and they truthfully explain the source of their procurement, they may be given a lighter or mitigated punishment.
