As we entered 2021, counterfeit infringement in the lighting industry flared up again; lighting companies have been tirelessly combating counterfeits. On February 18–19, NVC Lighting struck hard once more to defend its brand and crack down on "counterfeit goods"!
It is reported that on February 18, NVC Lighting (Huizhou NVC Optoelectronics Technology Co., Ltd.) had four new court hearings scheduled in a single day. The plaintiff in all cases was NVC Lighting, and the defendants were Anshun Tongfei Trading Co., Ltd., Panzhou Shuangfeng Mingfu Decorative Lighting Business Department, Qinglong County Dandan Decorative Lighting Store, and Mr. Xu. The causes of action were all disputes over trademark ownership and infringement. The four cases are scheduled for trial from February 20 to 23, 2021. It is understood that NVC Lighting has been involved in 296 judicial cases, primarily concerning trademark disputes.

As can be seen, the causes of action in the cases involving NVC Lighting are all disputes over trademark ownership and infringement. So, what is "trademark right"? "Trademark right", also known as "exclusive right to use a trademark", refers to the rights of possession, use, profit, and disposal enjoyed by the trademark owner over their registered or unregistered trademarks in accordance with legal provisions. Simply put, the main cause of disputes over trademark ownership and infringement is the manufacture of "counterfeit goods" by illegal manufacturers.
In the face of counterfeiting and infringement, NVC Lighting decisively took illegal manufacturers to court, once again drawing high attention from the industry to "anti-counterfeiting". In fact, in the LED lighting industry, counterfeiting and infringement are common occurrences. Some illegal manufacturers cloak their products with a "brand" exterior, infiltrating the market and disrupting order, which is detested by all.

Recently, the Shanghai Songjiang police solved a case involving the manufacture and sale of counterfeit luminaires, dismantling several counterfeit production and sales dens. According to reports, the Songjiang police received public tips about individuals selling counterfeit branded luminaires in the market. Following the leads, the Songjiang police tracked down and raided three luminaire counterfeiting dens in Lianyungang, Jiangsu Province, arresting 10 suspects, with the case involving a value of over 1 million yuan.
During interrogation, the suspect confessed to jointly producing "bare" luminaires (i.e., unbranded luminaires), then using privately carved counterfeit molds to imprint brand logos, and selling them for profit through online stores, physical stores, WeChat merchants, and other platforms.
In fact, as a leading brand in the lighting industry, NVC Lighting enjoys high brand and market recognition, making it a primary target for counterfeiting year after year. For top lighting enterprises, combating counterfeits is a long and arduous journey. Nevertheless, despite the hardships of the "anti-counterfeiting and rights protection path," these companies remain intolerant of infringement and refuse to back down!

On February 4, NVC Lighting issued a "Statement Letter" regarding the production or sale of related products by others in the online and offline markets, which are suspected of infringing on the "NVC" trademark rights. The statement declared: "Our company is the true right holder and owner of the NVC Lighting brand, possessing trademarks such as 'NVC' and 'NVC NVC Lighting'." NVC also solemnly reminded: "To protect the legitimate rights and interests of consumers, if you wish to purchase our products, please ensure you buy through our official online store and authorized dealers and other channels."
Even though lighting companies invest significant time, effort, and even money in combating counterfeiting, the cycle persists: "counterfeiting is fought every year, yet it recurs every year; it recurs every year, so it is fought every year," with counterfeit and infringing activities still occurring frequently.
Industry insiders indicate that the root cause is largely due to the low cost and high profit of counterfeiting and infringement. In cases of counterfeiting and infringement, illegal manufacturers not only avoid bearing high product R&D costs but also "coast to victory" by leveraging the market influence of well-known brands, thereby saving on brand promotion expenses. Furthermore, some manufacturers directly compromise product quality to lower production costs in order to earn higher profits.
Not only is "counterfeit manufacturing" unacceptable, but "selling counterfeits" is equally intolerable! As the saying goes, it takes two to tango. If no one were willing to buy counterfeit goods produced by illegal manufacturers, there would naturally be no market for them, leaving no room for counterfeits to exist. The problem, however, is that some merchants, in pursuit of greater profit margins, are willing to take high risks by choosing to "sell counterfeits." As a result, "counterfeit manufacturing" spirals further out of control.
When counterfeit goods are being sold, consumers play an essential and important role. Therefore, the police advise consumers to be vigilant and discern authenticity when purchasing products, buy from officially authorized stores through regular (Sales) channels, and promptly report any counterfeit or inferior goods to the industry and commerce authorities and public security departments.
Whether for enterprises, merchants, or consumers, combating counterfeiting and protecting rights is urgent. Enterprises must courageously fight counterfeits, merchants must refuse to sell fakes, and consumers must never buy counterfeit goods. Only by truly achieving "no manufacturing fakes, no selling fakes, no buying fakes" can we create a healthy and favorable lighting market environment.
