US ITC issues final determination in Section 337 investigation on LED landscape lighting fixtures and components

On October 6, 2021, the United States International Trade Commission (ITC) issued a notice announcing a partial final determination in Section 337 Investigation No. 337-TA-1261 regarding certain LED landscape lighting devices and components thereof: The Commission decided not to review the initial determination (No. 20) issued by the Administrative Law Judge on September 10, 2021, thereby terminating the investigation against the named respondents, U.S.-based Lumien Enterprise, Inc. d/b/a Lumien Lighting of Acworth, GA, and China-based Jiangsu Sur Lighting Co., Ltd. of Yancheng, Jiangsu Province, China, based on a consent order, and issuing the consent order.


On August 18, 2021, the United States International Trade Commission (ITC) issued its final determination: it would not review the initial determination (No. 14) made by the administrative law judge on August 4, 2021, meaning that the named defendants, Dauer Manufacturing Corp. of Medley, FL, USA, and FUSA Corp. of Medley, FL, USA, were default defendants.


On July 29, 2021, the United States International Trade Commission (ITC) issued its final determination: it would not review the initial determination (No. 13) made by the administrative law judge on July 9, 2021, meaning that the named defendant, cBright Lighting, Inc., of San Leandro, CA, USA, was considered a defaulting defendant.


On April 8, 2021, the United States International Trade Commission (ITC) voted to initiate a Section 337 investigation (Investigation No. 337-TA-1261) into certain LED landscape lighting devices and components thereof.


On March 9, 2021, Wangs Alliance Corporation d/b/a WAC Lighting of Port Washington, NY filed a complaint with the U.S. International Trade Commission (ITC) requesting an investigation under Section 337, alleging that the product exported to, imported into, and sold in the United States infringes its patents (U.S. Patent Nos. 10,571,101 and 10,920,971), and seeking a limited exclusion order and a cease and desist order from the U.S. ITC.


CAST Lighting LLC, Hawthorne, NJ, USA; Shenzhen Wanjia Lighting Co., Ltd. d/b/a WONKA, Guangdong, China; cBright Lighting, Inc., San Leandro, CA, USA; Dauer Manufacturing Corp., Medley, FL, USA; FUSA Corp., Medley, FL, USA; Lumien Enterprise, Inc. d/b/a Lumien Lighting, Acworth, GA, USA; and Jiangsu Sur Lighting Co., Ltd., Jiangsu, China are listed as defendants.
